Early Morning Alcohol Restriction Orders

The Crime and Security Act 2010 has amended the Licensing Act 2003 in that a licensing authority may make an order providing:

 

(a) premises licences and club premises certificates granted by the authority, and temporary event notices given to the authority, shall not have effect to the extent that they authorise the sale of alcohol between 3am and 6am, and

 

(b) club premises certificates granted by the authority shall not have effect to the extent that they authorise the supply of alcohol by or on behalf of a club to, or to the order of, a member of the club between 3am and 6am.

 

Where such an order is made it becomes enforceable on all premises where a premises licence, club premises certificate or temporary events notice is in force notwithstanding that the permitted hours were granted prior to the order being made. 

 

Where it is intended to make such an order the Licensing Authority will advertise the intention ito make an order and, hold a hearing to consider any relevant representations that are made by: 

 

 

 

Whilst the provisons have received royal assent the commencement date of these provisions are still not known.
