Disapplication of DPS Requirement
Village and Community Halls
Regulations allow for management committees of community halls to apply for a dispensation
from the need for a designated premises supervisor (DPS) provided
certain criteria are complied with:
1. There must be a properly formulated
management committee who will take responsibility for the control
of the sale of alcohol.
2. There must be a hiring agreement in
force that sets out the responsibility of hirers to ensure that the
licensing objectives are promoted.
Whilst it is not necessary for a committee
member to be at every event it will still be the responsibility of
the management committee if the Licensing Act 2003 is breached

to disapply the requirement for a DPS costs £23 where the sale
of alcohol is already an activity on the premises licence.
However, if the existing premises licence does not already
include the sale of alcohol it will be necessary to vary the
licence to include that activity. The cost of the variation
will depend on the non-domestic rateable value of the
premises. Also an annual fee would need to be
paid.
If the disapplication is granted the Licensing
Committee can require there to be a DPS if, at a review, it is shown that the licensing objectives are not being promoted e.g.
under aged sales are taking place or there is crime and disorder
associated with the sale of alcohol at the hall.
