Transfer of a Premises Licence

Where it is proposed to transfer a premises licence from an existing licensee to a new licensee an application for that transfer must be made to the Licensing Authority.  The application must be accompanied by the relevant fee.

 

Such transfers often entail a new designated premises supervisor (DPS) being put in place (where the licensable activities incude the sale of alcohol by retail).  Where this happens an application to vary the existing premises licence to change the DPS must be made at the same time.  Again the application must be accompanied by the relevant fee.

 

Due to the mandatory conditions under Section 19, Licensing Act 2003 if the licensable activities include the sale of alcohol and there is no current DPS then no sale of alcohol may take place.  There is no transitional period that allows sale without a DPS
