Gambling - Introduction

The Gambling Act 2005 came into force on 1 September 2005 and seeks to strengthen consumer protection in relation to gambling whilst reducing the burden of regulation. In doing so it replaces the provisions of three existing Acts of Parliament.

Grambling act replaces lotteries and amusements, gaming act and betting, gaming and lotteries act

The Gambling Act 2005 also set up a new regulator, the Gambling Commission, with powers to deal with gambling offences.

Licences

There will be three types of licences issued under the Act:

  • (a) Operating Licences issued by the Gambling Commission
  • (b) Personal Licences issued by the Gambling Commission
  • (c) Premises Licences issued by the Licensing Authority.

The Licensing Authority is the District, Unitary, or Metropolitan Council for a given area. Dover District Council is the Licensing Authority for its administrative area

Local authorities may also issue a number of permits in relation to lower risk gambling activities.

Licensing Objectives

The Gambling Act 2005 sets three licensing objectives:

  • (a) Preventing gambling from being a source of crime or disorder, being associated with crime or disorder or being used to support crime;
  • (b) Ensuring that gambling is conducted in a fair and open way, and
  • (c) Protecting children and other vulnerable persons from being harmed or exploited by gambling.
