Dog Breeding Establishment - Definition
Under Section 4A, Breeding of Dogs Act 1973 a dog breeding
establishment is defined as:
Where a person keeps a breeding establishment for dogs at any
premises if he/she carries on at those premises a business of
breeding dogs for sale (whether by him or another person)
where:
- a person keeps a bitch at any premises at any time during
any 12 month period; and
- the bitch gives birth to a litter of puppies at any time during
that period.
Carrying on a business of breeding dogs for sale is where 4 or
more litters are born during a 12 month period
Bitches falling within this definition are:
- any bitches falling within paragraph 2 above and any other
bitches kept by that person on the premises
- any bitches kept by a relative at the premises at any such
time
- any bitches kept elsewhere at any such time
- any bitches kept (anywhere) by any person under a breeding
arrangement
A breeding arrangement is one where an agreement or contract is
made that should the bitch give birth to puppies, the
other person is to provide him with:
- one or more of the puppies; or
- all or part of the proceeds of any sale
