Street Trading Exemptions

 The following are not street trading for the purposes of this legislation:

 

  1. Persons trading as a pedlar under a pedlar’s certificate issued by the police.

  2. Anything done in a market or fair that has been authorised by legislation or is an acquired right due to the time the market or fair has been in existence.

  3. Trading in a trunk road picnic area provided under the Highways Act 1980 although the permission of the Highways Agency may be required.

  4. Trading as a news vendor where the only articles sold, exposed or offered for sale are newspapers or periodicals. However they must either sold, exposed or offered without any stall or from a stall the dimension of which:

    a) does not exceed 1 metre square or 2 metres high;
    b) does not occupy a ground are exceeding 0.25 square metres; or
    c) does not stand on the carriageway of a street

  5. Trading which:

    a) is carried on at premises used as a petrol filling station
    b) is carried on at premises used as a shop or in a street adjoining premises so used and as part of the business of the shop

  6. Selling exposing or offering for sale any goods as a roundsman. A roundsman is somebody who follows a set route to attend on specific customers either to take orders or to deliver goods.

  7. The placing of any structure or other object on, in or over any highway for the purposes of trading. Whilst this is not a street trading offence Sections 147A & 148 Highways Act 1980 create similar, but not identical, offences.

  8. The operation of facilities for recreation or refreshment under Part VIIA of the Highways Act 1980.
