Enforcement

If development is carried out without planning permission first being obtained or is contrary to the terms of a permission, then action may be taken by the Council's Investigation Officers which could result in an Enforcement Notice or other legal notice being issued requiring the matter to be put right.

There is a right of appeal against an Enforcement Notice. Failure to comply with the Notice is an offence and can lead to prosecution in the Magistrates Court with the possibility of a heavy fine. The Council may also take direct action to clear land of unauthorised development.
