For the period 1 January 2021 – today, please provide:
A list of all properties where:
- A planning application exceeded the statutory determination period without decision, AND
- The property was charged Council Tax and/or Business Rates during that overdue period.
For each property, please provide:
- Planning application reference number
- Validation date
- Statutory determination expiry date
- Actual determination date (if any)
- Whether Council Tax was charged during that overdue period
- Whether business rates was charged during that overdue period
Names or ownership details are not requested.
Response
Attached is a list of planning applications from 1 January 2021 to today’s date where a planning application exceeded the statutory determination period without decision. The data shows the reference number, application type, the expiry, date decision issued and if it had an extension of time or not.
The Council’s planning data is not linked in any way to the Council Tax or Business Rate system. To determine whether the property was charged Council Tax and/or Business Rates during that ‘overdue’ period would require a manual search of every property in both the Council Tax and/or Business Rates database. As this would require a search of over 2,000 properties, we are refusing this part of your request in accordance with Section 12(1) of the Freedom of Information Act. This is because the information is not readily available and from our preliminary assessment, we have estimated that the cost of complying with your request would exceed the ‘appropriate limit’. The appropriate limit has been specified in regulations and for Local Government it is set at £450. This represents the estimated cost of one person spending 2½ working days in determining whether the information is held, locating, retrieving and extracting the data. I regret therefore, that on this occasion I must refuse this part of your request.
