Under the Freedom of Information Act, I am writing to politely request details of you Councils Section 106 spending.
Specifically, please could you provide the following details for each of the last 5 years:
- The total amount of unspent S106 funding
- The number of transport schemes funded by S106 in each financial year and the name of the corresponding schemes.
- The amount of S106 funding allocated to specific transport schemes during each financial year.
- Deadline for expenditure of S106 funds
- The amount of funds returned to developers due to expiry or inaction
- The amount of unspent funding at the end of each financial year which had been allocated to a transport scheme.
- The amount of S106 funding allocated specifically to sustainable transport [mobility solutions] schemes in each financial year and the name of the corresponding schemes.
- The amount of S106 funding upsent specifically allocated to sustainable transport schemes [mobility solutions] in each financial year.
Response
Highway, Sustainable Transport, footpaths and cycleway requirements are assessed by Local Highway Authority (KCC) and not DDC. As part of all planning applications, developers will need to submit a Transport Assessment/Statement and/or Travel Plan to detail any highway issues and sustainable transport options. KCC Highways will review this and determine whether the traffic generated from a scheme creates an issue that requires resolution through the provision of local road and/or footpath and cycle path improvements. KCC will in most circumstances be a signatory to a S106 agreement and collect any financial contributions secured for their services themselves. If offsite improvements are needed, then the developer may enter into a separate legal agreement (section 278) with KCC Highways to undertake the works required or make financial contributions towards the improvements.

There are three exceptions to this where Dover District Council manage the collection of financial contributions secured for transport related projects:
- Fast track Service: Dover Fastrack - Kent County Council The S106 contributions collected by DDC for this infrastructure project is transferred to KCC when invoiced. The information on this spend is reported in the IFS in the following financial years:
- Aylesham DRT Bus Service: Get onboard with the new on-demand bus service for Aylesham and surrounding villages | Stagecoach The S106 contributions collected for this infrastructure type, is retained by DDC and transferred to Stagecoach when invoiced. The information on this spend is reported in the IFS in the following financial years:
- Strategic Highway Tariff for Whitfield and Duke of York Roundabout improvements: Strategic Transport Infrastructure The S106 contributions collected for this infrastructure type, is retained by DDC and will be transferred to the authority who delivers the project (yet to be determined). The information on this spend is reported in the IFS in the following financial years:
Response to Questions 1, 2, 3, 6,7 and 8
Amendments to the Community Infrastructure Levy (CIL) regulations came into force on 01/09/2019, requiring local authorities to publish an Infrastructure Funding Statement (IFS) on their website by the end of each year. Dover District Council's Infrastructure Funding Statement will report on S106 developer contributions this statement will contain:
- Summary of all financial & non-financial developer contributions agreed in the monitoring year
- Amount of developer contributions held by the authority at the start of the monitoring year
- Details of developer contributions received and spent during the monitoring year
- Details of infrastructure the authority is intending to either wholly or part fund through S106 receipts
- Report on estimated future S106 income from developer contributions
