I am making this request under the Environmental Information Regulations 2004 (EIR).
I am seeking all information held by Dover District Council relating to the discharge of planning conditions and associated ecological mitigation for planning applications 22/01158 and 23/01095, including any linked Section 106 (S106) obligations.
This request specifically relates to:
- Ecological impacts, mitigation, compensation, and monitoring
- Toxic and contaminated soils
- Hazardous and non-hazardous waste disposal
- Soil and surface water drainage
- Discharge of chlorinated or treated water
- Ecological conditions and biodiversity requirements attached to the planning permission and/or S106 agreements
1. Documents Requested
A. Developer Submissions
Please provide all documents submitted by or on behalf of the developer/applicant relating to:
- Ecological surveys and assessments (including Extended Phase 1 Habitat Surveys, Phase 2 species-specific surveys, etc.)
- Biodiversity Net Gain (BNG) assessments and metrics
- Ecological Impact Assessments (EcIA)
- Mitigation, compensation, and habitat enhancement plans
- Construction Environmental Management Plans (CEMPs)
- Environmental Management & Monitoring Plans (EMMPs)
- Validation reports confirming delivery of ecological mitigation measures
- All reports, remediation strategies, and validation certificates relating to contaminated soils, waste disposal, water treatment, and drainage.
B. Developer’s Advisers and Consultants
- All materials, reports, strategies, or ecological monitoring data prepared by consultants or advisers engaged by the developer in connection with preparing for the discharge of ecological and environmental conditions.
- Any correspondence or submissions from ecological consultancies commissioned by the developer.
C. Section 106 (S106) Agreements & Monitoring
- Copies of any S106 agreements relevant to ecological, environmental, drainage, or biodiversity mitigation requirements.
- Monitoring reports provided under S106 obligations.
- Records of any developer contributions or actions required under S106 relating to:
- Habitat creation or restoration
- Ecological mitigation works
- Drainage or flood risk measures
- Off-site biodiversity enhancements or offsets.
D. Internal DDC Records
- All internal planning officer reports, notes, and correspondence regarding:
- Discharge of ecological and environmental conditions
- Delivery of mitigation measures
- Decisions on biodiversity offsets or S106 obligations.
- Records of internal ecological advice where relevant (including from council-appointed ecological officers or contractors).
E. Consultation Records
All consultation requests, responses, reports, and recommendations between Dover District Council and external consultees, including but not limited to:
- Dover District Council Environmental Health Officers (EHOs)
- Kent County Council Ecology Team / KCC Biodiversity Officers
- Natural England
- Environment Agency (EA)
- Kent County Council Lead Local Flood Authority (KCC LLFA)
- Southern Water / Thames Water
- UK Health Security Agency (UKHSA) (if consulted)
- Any ecological NGOs or independent experts consulted by DDC.
F. Decision Records
- Decision notices granting or refusing the discharge of conditions.
- Officer delegated reports and/or planning committee reports summarising ecological and environmental considerations.
- Evidence confirming that ecological mitigation measures and S106 obligations have been fully discharged.

- If any documents are already available on the Dover District Council planning portal, please provide direct links.
