Request

I am writing to make a request for information under the Freedom of Information Act in relation to planning applications DOV/13/00759 and DOV/16/00109, which both relate to the Nemo Link project. 

I request copies of all documents, correspondence, reports, drawings, certificates, and decision notices relating to the discharge of all planning conditions attached to these two planning permissions, including (but not limited to):

  • Applications to discharge conditions;
  • Officer reports and recommendations;
  • Technical reports, assessments, and submissions provided by the applicant or their agents;
  • Consultees’ responses (internal and external);
  • Decision notices approving or partially approving the discharge of conditions; and
  • Any correspondence between Dover District Council and the applicant or third parties regarding the discharge of conditions. 

I have attempted to identify and review all relevant conditions and their discharge status via Dover District Council’s planning portal. However, I have been unable to locate a complete and reliable record of all conditions or their discharge documentation on the portal. In particular, I note that Condition 31 (reference CON/13/00759/S) appears to have been discharged, yet there are no supporting documents available on the planning portal to explain how this condition was satisfied. 

Accordingly, I also request information explaining how each planning condition attached to DOV/13/00759 and DOV/16/00109 was discharged, including:

  • The date each condition was discharged;
  • The basis on which it was considered satisfied; and
  • References to the specific documents relied upon in reaching each decision.

Response

All condition applications associated with 13/00759 that have been submitted to the LPA are available on our website. In respect of 16/00109, the decision is online and the conditions attached to this decision did not require anything to be submitted to the LPA for discharge. The Council is not obliged to retain consultee comments/or officer reports and we do not therefore hold this information.
