  • I respectfully request that you provide us with all photographs associated with the 2019 planning application, whether taken by DDC during their site visit, as stated by [redacted], or any photographs provided by [redacted] or the [redacted] family, particularly those of the access area.
  • we formally request a copy of the complete communication—telephone calls, emails, and letters—between you and [redacted], as well as [redacted], from the inception of our correspondence until the present.

This request was clarified as follows:

  • In regard to the reference number is is CON/ 19/01249/B. The communication period requested is from beginning of 2022 up to date, and the officer concerned with the communications was the Planning Team Leader. Also [redacted].

Response

The majority of the information held by the Council is available on the Council’s website on the planning portal.  However, there are a number of emails that are not on the portal and copies of these are attached.  Please note that all personal data has been redacted from the attached documents as this is exempt from disclosure under Regulation 13(1) of the Environmental Information Regulations.  The Council considers the names and contact details of individuals to be personal data.  Personal data is defined by Article 4(1) of GDPR and also Section 3 of the Data Protection Act 2018 and the release of this data would contravene the data protection principles.

Internal Review Request:

It appears that a substantial amount of information has been redacted, and not all emails have been provided. 

With regard to Regulation 13/1 and Article 4/1 of the GDPR, I would like to confirm my willingness to comply with these regulations; however, I cannot agree to selective or manipulated disclosures that may obstruct the emergence of the truth. I have observed numerous emails exchanged between [redacted] and the [redacted] family, as well as correspondence between the planning department and [redacted]. I must assert that these emails have not been supplied in their entirety. My primary concern pertains to a specific email dated 03/10/2022, sent from [redacted] to [redacted] at 2:38pm, with the subject line "Appointment." Notably, the third sentence from the end has been significantly redacted, which, upon reviewing the email's content, suggests that the redaction pertains to me personally. Given that this email originates from an official source, namely DDC, I firmly believe that it does not contain any personal information, as it constitutes an official document that falls outside the aforementioned articles. Therefore, I would appreciate it if you could provide the complete email without such extensive redactions, as it is imperative that we remain grounded in factual information. 

At the heart of this matter lies a boundary dispute, which the planning department has adjudicated. 

Concerning the photographs and plans referenced in the emails, I reiterate that these documents have not been included, and I request the provision of all such materials, as well as any revised plans. 

We suspect that there was correspondence between the DDC planning department and the tree arboriculturist, which we request to be furnished, along with all associated photographs. 

It is inconceivable that there are no emails exchanged between Axis Land Surveying and the planning department, especially considering the email exchanges indicate an ongoing boundary dispute between [redacted] and [redacted]. In our initial email, we have requested access to all call logs and meetings involving the [redacted], particularly with Planning Team Leader, who played a significant role in the approval of the planning permission. The correspondence suggests that he advocated strongly among his colleagues to secure the passage of the planning application, despite the ongoing legal proceedings regarding the land dispute related to my property, especially concerning the west boundary and access, which we suspect could be racially motivated, as it appears that he had been influenced by [redacted]. 

Internal Review Response:

I can advise that I have now had the opportunity to look into this matter further and respond with my findings. 

I have confirmed with the department that the majority of the information held is already published on the Planning portal, on the Council’s website and therefore available to view.  The information already provided is the only information they have identified as not being available.  So I am satisfied you have been provided with all additional data held.   I have then reviewed the redactions on the documents provided to you previously and attach those where I have made changes to the redactions.  The information still redacted is third party data and therefore would be classed as exempt from disclosure in accordance with Section 40 of the Freedom of Information Act.   

Whilst going through the information I noted there were some images of footings included within an email, so I have also attached these as you had requested photographs.  These were all I have located. 

In addition, you submitted an email dated 30 April 2025 in which you ask about email exchanges between the Planning Department and Mowll & Mowll  Solicitors, specifically involving [redacted].  I asked Planning to check to see what information they hold in this respect and can confirm there is nothing on file relating to this application from Mowll & Mowll Solicitors.
